Eviction Process

1. The landlord must serve a written notice of eviction to the tenant.

2 The tenant has 30 days from the date of service to vacate the premises.

3. If the tenant fails to vacate within 30 days, the landlord must file for an eviction hearing at the Edmonson County Circuit Clerk’s Office.

4. Both the landlord and the tenant will receive a Notice of Eviction Hearing, requiring their appearance before a judge on the specified court date.

5. If the tenant still does not vacate as ordered by the judge, the property owner must file for a Writ of Possession or Forcible Detainer at the Edmonson County Circuit Clerk’s Office.

6. The Writ of Possession or Forcible Detainer must be serviced by a Sheriff’s Deputy.

Fees:

Our office charges $70 fee for each notice served.
